● Our rental portal – hosted on Buildium, where tenants can pay rent, submit maintenance requests, and update information.
● Our messaging services – including SMS/text messages we send about your lease, property updates, maintenance, or appointments.
By visiting our website, logging into the tenant portal, or communicating with us through SMS/text or other services, you are agreeing to follow these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our website, portal, or messaging services.
Use of Services
You agree to use Falcon View LLC’s website, rental portal, and communication services only for lawful and authorized purposes.
This means you must NOT:
● Break any laws – including local city ordinances, Georgia state laws, or U.S. federal regulations.
● Access information or accounts that aren’t yours – this includes trying to hack, guess passwords, or bypass security systems.
● Post or send false, misleading, or offensive information – including harassment, discrimination, or defamatory statements.
● Tamper with or disrupt our systems – for example, spreading malware, attempting denial-of-service attacks, or interfering with our website, portal, or communication tools in any way.
Clarification: If you misuse our services, we may suspend or terminate your account, deny you access to our systems, and take legal action if necessary.
Tenant Portal Rules
If you are a registered tenant using our Buildium Resident Portal, you agree to follow these rules:
● Keep your login credentials secure — Do not share your username or password with anyone else. You are responsible for any activity that occurs under your account.
● Provide accurate and current information — Ensure that all contact details, payment information, and maintenance requests you submit are truthful and up to date.
● Use the portal only for tenancy-related purposes — Examples include paying rent, submitting repair requests, viewing lease documents, or updating your contact information.
● Do not upload harmful content — This includes viruses, malicious software, or any files that could damage our systems or compromise the security of other users.
Clarification: Failure to comply with these rules may result in restricted access to the portal, suspension of your account, or other lease enforcement actions.
SMS/Text Messaging Consent
By providing your phone number to Falcon View LLC, you consent to receive SMS/text messages related to your tenancy.
These messages may include:
● Appointment reminders — For scheduled property tours, inspections, or meetings.
● Maintenance updates — Notifications about repair schedules, work order progress, or completed service requests.
● Lease or account notifications — Information on lease renewals, payment reminders, policy changes, or account status updates.
● Urgent property notices — Time-sensitive alerts such as emergencies, utility outages, weather-related closures, or safety advisories.
Terms for SMS/Text Messaging:
● Message frequency may vary depending on your account activity and communication needs.
● Message and data rates may apply based on your mobile carrier plan.
● To opt out, reply with STOP at any time.
● To get help, reply with HELP or contact us directly.
● We do not sell, share, or transfer your SMS consent to third parties for marketing purposes.
Clarification: SMS communications are intended solely to provide necessary tenancy-related information. Opting out of SMS may limit our ability to send you urgent or time-sensitive updates, so we recommend keeping at least one active communication channel with us.
Intellectual Property
All content on the Falcon View LLC website, rental portal, and related materials — including text, images, graphics, logos, design elements, layout, videos, and downloadable documents — is the exclusive property of Falcon View LLC or its authorized licensors. You may not:
● Copy, reproduce, or republish any content without our prior written consent.
● Modify, alter, or create derivative works based on our content.
● Distribute, sell, or use our materials for commercial purposes without authorization.
Clarification: All intellectual property is protected under applicable copyright, trademark, and intellectual property laws in the United States and internationally. Unauthorized use of our materials may result in legal action, including but not limited to claims for damages, injunctive relief, and recovery of legal fees.
Payment Terms
By making payments through the Falcon View LLC payment portal (including the Buildium Resident Portal), you agree to the following:
● Provide accurate billing details — You must ensure that all payment information, including your billing address and payment method, is correct and up to date.
● Authorize payment processing — You give Falcon View LLC and our secure third-party payment processors permission to process your payments in accordance with your lease or service agreement.
● Acknowledge late payment consequences — Any late payments may result in late fees, penalties, or other charges as outlined in your signed lease or rental agreement.
● Understand payment security — All payments are processed through secure, encrypted systems. Falcon View LLC does not store your full credit card or bank account information.
Clarification: Failure to make timely payments may result in additional charges, suspension of services, or lease enforcement actions, up to and including eviction in accordance with applicable laws.
Limitation of Liability
To the fullest extent permitted by law, Falcon View LLC will not be held liable for any damages, losses, or claims arising from:
● Inability to use our services — This includes downtime, technical errors, or system interruptions.
● Security breaches beyond our control — While we take reasonable measures to protect your information, we cannot guarantee that unauthorized access, hacking, or data breaches will never occur.
● Third-party content or services — We are not responsible for any content, actions, or services provided by external websites, vendors, or partners that you choose to interact with through our platform.
Clarification: Our liability, if any, will be limited to the total amount you have paid to Falcon View LLC in the 12 months prior to the claim. We are not responsible for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruptions.
Changes to Terms
We may revise or update these Terms & Conditions at any time to reflect:
● Changes in our services or features.
● Updates in technology, security practices, or applicable laws.
● Adjustments to business operations or policies.
When updates are made, we will post the revised Terms on our website and indicate the “Effective Date” at the top of the page.

Governing Law
These Terms & Conditions, as well as any disputes or claims arising from your use of our website, portal, or services, are governed by and will be interpreted in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law principles. You agree that any legal action or proceeding related to these Terms will be brought exclusively in the state or federal courts located in Georgia, and you consent to the jurisdiction of those courts.
